Frequently Asked Questions
Maui wildfire lawsuits are legal actions brought by individuals, families, and businesses whose lives were upended by catastrophic wildfires on the island. These lawsuits seek compensation for property loss, injuries, financial hardship, and emotional trauma. They typically allege that utility companies, landowners, or government agencies failed to take reasonable action to prevent or contain the fires. Many claims also involve first-party insurance disputes, where homeowners or business policyholders were underpaid, delayed, or denied coverage by their own insurance companies after the fire.
A first-party insurance claim is a claim you file with your own insurance company under your homeowner’s, renter’s, or commercial policy to cover losses caused by the fire—such as property damage, smoke damage, business interruption, and additional living expenses. These claims are separate from lawsuits against third parties like utilities or the government. If your insurance company fails to honor your policy in full and in good faith, you may also have a bad faith insurance claim in addition to any wildfire litigation.
You may qualify to file a wildfire lawsuit, insurance claim, or both if you:
- Owned or rented a home or business damaged by the wildfire
- Filed a first-party insurance claim and were underpaid, delayed, or denied
- Suffered physical injuries or medical issues from smoke or burns
- Experienced loss of business income or employment disruption
- Incurred evacuation costs or were displaced from your home
- Lost a loved one due to the fire
Even if you already received an insurance payout, you may still qualify for additional compensation through litigation.
Victims of the Maui fires may be entitled to recover damages for:
- Real and personal property damage
- Smoke and ash contamination
- Loss of income or business interruption
- Evacuation costs and temporary housing
- Medical expenses
- Mental anguish and emotional distress
- Wrongful death or loss of companionship
- Bad faith insurance conduct (if your insurer mishandled your claim)
We pursue both first-party insurance claims and third-party lawsuits to ensure you recover every dollar you're owed.
Responsible parties may include:
- Utility companies that failed to shut off power or maintain power lines
- Private landowners who failed to mitigate known fire hazards
- Government entities that failed in emergency response or vegetation management
- Contractors or workers whose actions may have started or spread the fire
- Insurance companies that unreasonably denied, delayed, or lowballed claims
We aggressively investigate all avenues—especially when insurance companies try to shift blame or minimize payouts.
These lawsuits are typically based on:
- Negligence – Failure to exercise reasonable care in preventing fires
- Public nuisance – Allowing conditions that endangered public safety
- Inverse condemnation – Where government action destroys private property
- Strict liability – For inherently dangerous activities
- Bad faith insurance practices – Where insurers violate their duty to policyholders
If your first-party insurance claim was denied or mishandled, that alone may justify legal action under Hawaii’s insurance laws.
You have the right to:
- Prompt, full, and fair payment for covered losses
- Coverage for fire, smoke, soot, debris removal, and displacement costs
- Protection from bad faith delays, denials, or underpayments
If your insurer is acting in bad faith—by dragging out your claim or refusing to pay—you may be entitled to extra-contractual damages beyond your policy limit.
- Document all losses – Photograph damage, make an inventory, and retain receipts
- File an insurance claim immediately – Don’t delay or wait for FEMA
- Request a complete copy of your insurance policy
- Track communications with your insurer – Save letters, emails, and claim notes
- Speak with a wildfire and insurance litigation attorney – We’ll evaluate your situation and take over the legal burden
Whether you’re dealing with a denied insurance claim or need help suing the party responsible for the fire, we’re here to help.
Under Hawaii law, the general statute of limitations for property damage and personal injury claims is two years from the date of loss. The same deadline typically applies to insurance bad faith claims. Some deadlines could be shorter depending on the party involved (e.g., claims against the government). Delays may bar your right to recover—act now.
Even if you’ve received an insurance payout, it may not reflect the true value of your losses. Our firm often helps clients:
- Reopen first-party insurance claims
- Challenge lowball or partial payments
- File additional claims for overlooked damages
- Pursue lawsuits for wrongful denials or delays
Insurance is just one piece of the puzzle. If utility or government negligence contributed to the wildfire, you may also be entitled to compensation through a lawsuit.
Not necessarily. Many claims resolve through:
- Mass tort litigation
- Insurance negotiations
- Structured settlements
- Mediation or arbitration
Our goal is to secure the highest compensation possible, whether through settlement or trial. We prepare every case for court—but aim to avoid it if it’s in your best interest.
Our firm works on a contingency fee basis:
- No upfront cost
- No out-of-pocket fees
- We only get paid if we win
This includes all first-party insurance claim disputes and wildfire lawsuits—so there’s no risk in speaking with us.
- Deep experience in first-party insurance litigation
- Track record of results in wildfire, hurricane, and disaster cases
- We represent local residents, not outside investors
- You’ll work with a Hawaii-based team who understands local law, land, and people
- We care about helping you rebuild, not just recover
